NAG MASTO wants “kill switch” on cell phones for her “police state”

Nevada Attorney General Catherine Cortez Masto’s office is drafting legislation to require “kill switches” on cell phones sold in the state. The switch allows the owner to remotely disable the phone if it is stolen, creating a disincentive for thieves, but it also allows others—such as the police—to do the same.

The Cortez Masto draft may be unnecessary by the time it is submitted to the Nevada Legislature. Given the huge size of the California market—the state makes up just over 12 percent of the population of the United States—it’s possible that phone manufacturers will build the kill switches into all models rather than provide switch-free versions to states that have no such requirement.

The attorney general is allowed to request up to 20 drafts of legislation from the legislative bill drafters. But Cortez Masto is termed out and will be out of office by the time the legislature goes into session next year, so it will be the decision of her successor whether to continue with the kill switch measure. Candidates for the job are Republican Adam Laxalt and Democrat Ross Miller.

Mobile carriers say the switches will make smart phones more susceptible to hackers and the Electronic Frontier Foundation, in a letter to California legislator Susan Bonilla, opposed the legislation, saying the technology was already available on an optional basis and the legislation “is not explicit about who can activate such a switch. … [M]andating a solution through legislation is not the right approach.”

But Consumers Union supported the legislation, less for theft prevention than because the smart phones contain so much private information. The organization conceded that kill technology is already available but said its inclusion in devices should be mandatory by law. “Every smart phone should be required to have a ‘kill switch’ that lets you wipe personal information off your device,” it said in a prepared statement. “What’s more, you should be able to disable your phone remotely to make it inoperable to thieves. And if you’re fortunate enough to get your phone back, it should be easy to reactivate.”

On Aug. 11, 2011, during protests on Bay Area Rapid Transit stations against a police killing of a homeless man, BART disabled cell service to four stations to hamper coordination of the protests. That angered some residents who joined the subsequent day’s protest. It also sparked a Federal Communications Commission investigation of BART and prompted the California Legislature to pass a law limiting official interference with cell transmissions.

It’s not just community groups whose work could be disrupted. The Columbia Journalism Review described the problem for photographers and reporters: “You’re a journalist covering a street protest, and the local police chief doesn’t like the photos you’re tweeting from your iPhone. One shows an officer arresting a minister. Another shows a protester surrendering as an officer chokes him. Yet another shows a teargas canister landing near a group of young people. The batons and rubber bullets come out, and the chief remotely disables the journalist’s iPhone, rendering it useless.”

The blockage may not stop reporting of a news event, but it slows things down until law enforcement gets all its ducks and spin doctors in a row and may well get its account of an event out before on-the-scene observers. In California, that would likely be illegal under the post-BART protest law, but what are the chances that local prosecutors will charge the police with a crime? In Nevada, there is no crime to charge.

Leon Benzer, the accused mastermind of a massive scheme to take over homeowners associations in the Las Vegas Valley, told federal authorities nearly two years ago that he once consulted with Nevada Attorney General Catherine Cortez Masto about his dealings.

Benzer said Masto indicated during a “face-to face” meeting that she approved of his actions, according to a report of a 2011 debriefing authorities conducted with the former construction company boss.

“Masto advised Benzer that she did not have problems with what he was doing, to which she added he had overzealous competitors,” Las Vegas police detective Robert Whiteley wrote after the meeting with Benzer.

Whiteley and FBI Agent Mike Elliott are the lead agents in the long-running federal investigation into the takeover scheme, which occurred between 2003 and 2009.

Two pages of Whiteley’s six-page report were made public this week by defense lawyer Chris Rasmussen with court papers seeking to have his client, Benzer’s half-sister Edith Gillespie, tried separately from Benzer. Rasmussen redacted parts of the pages.

According to Whiteley’s report, Benzer told authorities that the late attorney David Amesbury, a former business partner who pleaded guilty in the scheme, introduced him to Masto. Amesbury killed himself in March 2012.

Investigators followed up on Benzer’s claim and interviewed Masto. Masto has not been accused of any wrongdoing.

On Tuesday, Masto told the Review-Journal she did meet Benzer, but not while she was attorney general. The meeting took place in 2006 while she was running for the office, and the subject of his sweeping business operation did not come up, she said.

“He did not talk to me about his scheme,” Masto said. “Had he talked to me about his scheme, I would have told him he couldn’t do it. It was illegal.” Continue reading

Washoe DA “Dick” Gammick says he won’t run for re-election in 2014

Gammick made the announcement while taping an episode of Nevada NewsMakers with Sam Shad this morning in Carson City. The show will air at 12:30 p.m. on KRNV.

“I’m not going to run for election again,” Gammick said. “My term is over January 2015.”

During the taping, Gammick endorsed Deputy District Attorney Chris Hicks, an 11-year veteran of the office who has prosecuted some of the region’s most high profile cases in the last decade. Hicks announced he will run for the office in 2014 during a separate segment on the show. “I’m behind him 100 percent,” Gammick said. “I think he’s a hell of an individual.”

Sheriff Mike Haley said he and Gammick built a healthy and professional relationship even if they did not always see eye to eye.

“Most disagreements centered around attitude about bigger issues, not specifically about one case or another case,” Haley said on Tuesday. “It was more often about how justice can be interpreted and maybe it wasn’t always that the bad guy had to go to jail. Maybe sometimes it was about what was the best strategy to deal with a particular criminal issue in the area of prevention and treatment.”

Nevada Attorney General Catherine Cortez Masto said Gammick’s legacy will show he was passionate about supporting victims of crime.

“He did an excellent job protecting Nevadans by holding criminals accountable,” Masto said in a statement. “Though he can never be fully replaced, we look forward to continuing our strong working relationship with the Washoe County District Attorney’s Office.”

Gammick has spent more than 40 years working in either law enforcement or as a prosecutor in Northern Nevada. Before running for district attorney in 1994 as a dark horse challenger, Gammick had already spent 10 years in the district attorney’s office under former DA Mills Lane.

Gammick, a Republican known for his blunt public persona, went on to win five terms with little electoral opposition until the 2010 election.

“He certainly had some detractors and certainly was not shy about taking on cases or being in the media,” said Eric Herzik, the political science department chairman at the University of Nevada, Reno. “But that’s not unusual for Washoe County DAs when you think of Bill Raggio, when you think of Mills Lane.”

Herzik added, “I would say he certainly served a long and successful tenure.”

Fred Lokken, a political science professor at the Truckee Meadows Community College, said Gammick was no stranger to controversy during his tenure, including the way his office handled the prosecution of Darren Mack, the Reno man who was ultimately convicted of murdering his wife and shooting a Family Court judge.

Gammick also drew the ire of the Washoe County Employee Association in 2011 after Kelli Viloria, a 14-year veteran prosecutor with the district attorney’s office, said she was forced to resign.

She and the employee group alleged she was fired in retaliation for lobbying state lawmakers to prevent district attorney office workers from becoming at-will employees, meaning they could be fired without cause.

Gammick called the allegations “a bunch of crap,” according to the Reno Gazette-Journal.

Regardless, “his ability to be re-elected suggested he was popular with the public,” Lokken said, noting Gammick developed a media-friendly law-and-order personality over the course of his career.

For example, Gammick told Shad on Tuesday, “A guilty verdict is better than sex.”

“The ruffling of feathers has kind of created a bit of a cult following for him,” Lokken said. “The perception was something that kind of (became) the basis for his electoral support.”

Gammick remains involved in several charitable causes in the region, including the Boys & Girls Club of Truckee Meadows and the Reno Rodeo Association.

Caesar Ibarra, the chairman of the board of the local Boys & Girls Club, said Gammick has been a longtime supporter of the organization.

“From his perspective I assume he sees and deals with a lot of stuff and he knows it starts at childhood,” Ibarra said. “If a kid has a good foundation they’re more likely to be a good citizen.”

Ed Basl, the Democrat who unsuccessfully ran against Gammick in the 1994, congratulated his former colleague from the Washoe County District Attorney’s office in an interview on Tuesday.

Today, Basl runs a Reno law firm and said it will be sometime before Gammick’s legacy is fully realized.

“Anytime anybody has been in there for 15 to 20 years you know that they earned it, and you can’t take any of that away,” Basl said.

Wilson Jr. (a Mormon) and his involvement with the backdating scandal from 2012.The scandal included fabricated and withheld evidence, edited transcripts, perjury and more.

Nevada Attorney General Catherine Cortez Masto and her crony named Ann McDermott from Las Vegas along with the court clerk are implicated in the scandal.

The following is my explanation as to why the judicial officer named in this complaint has violated the Nevada Code of Judicial Conduct or suffers from a disability.

The judge did the following things that I believe constitute misconduct (please be as specific as possible about the event or action and attach additional pages, if required).

I am writing this judicial ethics compliant against the very, very corrupt and impaired Justice of the Peace (“JP”) John Tatro of the Carson City Justice Court. “JP Tatro is not a well man.” Says my lawyer William Routsis recalling an episode of JP Tatro yelling, frothing at the mouth and lunging over the bench at Mr. Routsis. The incident was caught on the court audio/video. JP Taro has a long history of judicial complaints and violations of the Judicial Code of Conduct (“NCJC”) including a similar complaint in 2006 against JP Tatro by activist Tonja Brown. Ms. Brown and I are both ANTI Corruption activists in Carson City, NV and have protested against the Carson City courthouse. Both of us have had negative experiences with courthouse Department of Alternative Sentencing (“DAS”) $$ A FOR PROFIT ENTERPRISE $$  The DAS is also known as the (“KGB”). Ms. Brown was abused and arrested by the DAS for alleged “trespassing” into the courthouse to refresh herself! The courthouse is a public building.

last summer we got to meet most of the Nevada Department of Public Safety – Capitol Police Division and our experience with them was very positive. These fellas (and the ladies) were all very professional when we did our protests and they talked with us and some got to know us and what we were standing up for – our rights. This Las Vegas SUN news story caught our attention because of the various innuendos including Governor Brian Sandoval’s comment that we feel may have been directed at us!

The governor acknowledged there were no threats made in the past at these meetings of state elected officials. There may have been some nasty comments but nothing threatening.

Perhaps Governor “Sunshine” did not like the harsh criticism directed at him and his sidekick Nevada Attorney General Catherine Cortez Masto by Guy Felton and the Nevada ANTI-Corruption movement. The Las Vegas press does an OK job at exposing the Sin City Corruption.  LV Sun always runs a good story about once a week on Las Vegas Corruption: Judge Valorie Vega says ethics charges lack merit. The local newspaper Las Vegas Sun and its editor Hank Greenspun led a crusade in the earlydays to expose all the criminal ties, activities, and government corruption in Las Vegas. His investigative reporting and editorials led to the exposure of Clark County Sheriff Glen Jones‘ ownership of a brothel and the resignation of Lieutenant Governor Clifford A. Jones as the state’s national committeeman for the Democratic Party. Before his death in 1989, Hank Greenspun founded The Greenspun Corporation to manage his family’s assets, and it remains a major influence in Las Vegas, with media holdings in print, television and the Internet; substantial real estate holdings; and ownership stakes in a number of casinos.

Highbeam.com, an online research tool conducted a recent study. Of 10 cities listed in the study, Las Vegas came in 10th.

Find anyone on the street of Las Vegas and they’ll belly laugh, or run away quickly, because someone stopped them to ask the question: “Is Las Vegas corrupt?”

We’ve had bribery scandals that landed four county commissioners in federal prison; we’ve had suicides, court battles and convictions related to a years-long case involving homeowner association boards and attorneys trying to cash in on home-defect allegations.

We all “know” lobbyists and casinos run our state Legislature.

Even local firefighters have been called corrupt after county officials and an independent arbitrator pointed to firefighters’ apparent use of sick-leave to run up overtime hours. The FBI is still investigating the matter.

A Nevada Advocate and Activist against Nevada Government/Judicial Corruption was arrested with no Due Process in Carson City Nevada. Nevada has become a “Police State” in the New United States using new US law Senate Bill S.1867 where Americans can be detained without due process. In Nevada anyone can be detained without cause and held in the Carson City Jail for months until a trial is set by the judge, who can keep people detained for excessive amounts of time before their trial… And in Nevada, you will not get a jury trial for a misdemeanor.

His spokesman Dmitry Peskov told Russian news agencies Wednesday that Putin would be willing to review the treason law if its implementation reveals “some problems or aspects restricting rights and freedoms.”

Definition of Treason in the state of Nevada.
In Nevada the definition of Treason is found in chapter 196 of the Nevada revised statutes. An act of Treason can be committed in three ways. The three ways include:

(a) Levying War against the people of the state;
(b) Adhering to its enemies; or
(c) Giving them aid and comfort

Specifically we will first take a look at the definition of “Levying war against the people of that state”. The definition states, “When persons arise in insurrection with intent to prevent, in general, by force and intimidation, the execution of a statute of this state, or to force its repeal, they shall be guilty of levying war.”

One simple way to prove that State Officials, State Judges, DA’s and Carson City and its Sheriff department are often times levying war against the people of that state is by comparing its continual promotion of sin to its responsibility under the law to promote Good Morals and Public Decency. Robben’s sentence deferred in disorderly conduct case

Ty Robben, who has been battling all levels of government since his termination from the Nevada Department of Taxation, has pleaded no contest to charges in a deal that resolves his case. In an email, Robben said his interpretation of the sequence of events is that all charges against him were dropped. Carson City Deputy District Attorney Travis Lucia, who prosecuted the case, said Robben pleaded no contest to a charge of disorderly conduct to settle charges against him. He said the deal requires Robben to comply with a variety of conditions designed to ensure good conduct and prevent harassment of other officials. Those conditions remain for a full year. “If he’s a good boy, it all goes away,” said District Attorney Neil Rombardo. “But if he keeps up the conduct he has been doing, we’re going to prosecute on anything new.” Robben was originally charged with assault after an incident in which he says he was attempting to serve a subpoena on NDOT Director Susan Martinovich to appear at a hearing involving a friend. That friend, Jim Richardson, is fighting to get his job as a state pilot back. Robben was originally charged after Martinovich asked for a restraining order, saying he followed her vehicle from NDOT to the Smith’s parking lot after she refused to see him. Martinovich wrote that, as she was getting into her  vehicle, “a man started running towards me yelling.” She said she felt threatened and drove away but that he grabbed the door handle of the vehicle and was pounding on the side of the car. After that arrest and a subsequent arrest for violating bail provisions, Robben spent several days in jail. He expanded his verbal attacks to include not only Justice of the Peace John Tatro but Sheriff Ken Furlong and District Attorney Neil Rombardo.

This NV Appeal story does cover the “differed” prosecution of the  “breach-of-peace” charge and fails to report that the main “Assault” charge was in fact “dismissed”. There was little choice with the coercion tactics and  having an extremely corrupt and bias bias judge named John Tatro in control of this sham. Robben was not going to have a fair judge handle this case and he was not going to have a jury trail as he requested. Instead the court recused Judge Tom Armstrong who may have offered a fair trail to Judge John Tatro where a definite conflict-of-interest persists.  Robben has laid down several reasons why Judge john Tatro should have been recused/disqualified from this case in court filings and in this website.

We feel that the Taxpayers who pay these people deserve answers to legitimate questions about these “political” figures who are elected and are subject to public questioning, public ridicule exposing their corruption and even simple political hyperbole.

Our “opinion” is that the Carson City Sheriff under control of Ken Furlong (who also went to Carson HS with judge Tatro and  Martinovich) did cover-up the hit-and-run report and still has evaded giving the final reports to the insurance companies (as reported by the insurance company).  The  DA Neil Rombardo took the initial Sheriff report that never included  an “assault” or “breach-of-peace” charge and added these trumped up charges nearly 2-weeks after the incident where Robben was never initially charge or arrested. The time frame for the trumped up charges came after an embarrassing KRNV Fact Finder story that showed Martinovich in a bad light by evading service and the hit-and-run… Clearly the charges against Robben were trumped up retaliation by the DA who’s Deputy DA named Gerald Gardner immediately became Governor Brian Sandoval’s new Chief-of-Staff during all of this.

Hot August NV ANTI-CORRUPTION Protests – Rockin’ the Reno Roundabout Aug. 03, 2012

We took the Nevada ANTI-CORRUPTION protest to Reno again for a day of protest in front of the Reno office of Nevada Attorney General Catherine Cortez Masto on Kietzke Lane at the round-a-bout.

DAWN PATROL – We got there early and setup under the smokey sunrise and captivated the morning rush hour traffic.

The CRIME SCENE banner was in full force and the signage commanded the attention of everyone including the Reno 911 Police Department who showed up in an unmarked cruiser.   The property management also took notice.  In the end, the RPD and  property management folks were supportive and respected out 1st amendment rights.  The peaceful protest continued and our CRIME SCENE banner was still there for the duration of the protest at 5:00pm.

We thank RPD, the property management and the other businesses in the area for their understanding.  We will be back at this location to shoot TV news footage at a later date. We respect the businesses in the area and we will try to comply with any requests.  We are also at the mercy of the weather and wind in particular, so if we protests here again, we will try to have out banner flying before noon and we will shut down at a time to be determined.

NV tax director abruptly retires after audit flap

Nevada’s top tax man abruptly retired Friday, a day after he revealed his agency hadn’t audited mining industry tax collections in two years and lacked trained staff to determine if the mining companies were paying proper net proceeds taxes.

In a statement, Gov. Brian Sandoval thanked Dino DiCianno for his years of service and wished him well in his retirement.

“He has been a loyal and dedicated public servant for three decades,” Sandoval said.

The governor said Chris Nielsen, taxation deputy director, will lead the agency until a permanent replacement is found.

Sandoval asked Nielsen to prepare a transition plan and immediate strategy to resume auditing mine operators to ensure the proper payment of the net proceeds of minerals tax. He also directed the state’s Internal Audit Division to assist the tax agency.

In a hearing Thursday before the Senate Revenue Committee, DiCianno told lawmakers that his department only had two-and-a-half people to conduct audits, and that they relied largely on the companies’ revenue projections and reports in calculating taxes.

It prompted a terse exchange with Senate Majority Leader Steven Horsford, D-North Las Vegas, who at one point said he may “need to start taking blood pressure medication.”

DiCianno also said the governor was unaware of the lack of audits, but that he had asked his staff to “dust off the internal audit manual” and get up to speed.

Nevada’s mining industry, with gold prices soaring to record highs, is a shining target in the gloom of the state’s budget battles as the state tries to claw its way out of the Great Recession while leading the nation in joblessness, foreclosures and bankruptcies.

Also revealed during Thursday’s hearing were the business deductions the mining industry is allowed to take before declaring their taxable net income. The deductions include an array of expenses including advertising costs, severance payments, employee or worker bonuses and sales tax.

According to the taxation department, deductions for Barrick Gold Corp. will amount to $1.7 billion this year. These deductions lower the mining company’s taxable income to $1 billion. Were taxation based on gross income instead of net, the tax department’s report shows Barrick would face taxes on almost $2 billion in 2011.

On April 2, 2009, while appearing before a legislative panel to promote his renewable energy bill, Gibbons pulled out his cellphone and began texting. News stories used this incident to revisit the 860 messages he sent to his alleged paramour, and a 37-second video of him introducing himself to the panel, with a 17-second break in order to send the text message and refocus on the hearing was posted on YouTube

Jim Gibbons pledged during his 1996 campaign for governor to not impose new taxes on businesses or individuals in Nevada.[63] Gibbons broke his tax pledge on several occasions. The state’s Business Tax on employer’s payrolls which was initiated in 1992 was increased under Gibbon’s term and renamed the “Modified Business Tax”. Various mandatory fees and licenses administered by the Nevada Department of Taxation were also significantly increased under Gibbon’s term. Most particularly was the State of Nevada’s yearly business license fee. This license fee was doubled from $100.00 to $200.00. Due to the additional tax burden of the increased Modified Business Tax on Nevada’s small businesses during a downward business cycle, this tax was readjusted to a lesser rate by the 2011 Nevada legislative session during the leadership of Governor Brian Sandoval.
It was also discovered during the 2011 Nevada Legislative hearings that the Nevada Department of Taxation’s director, Dino DiCianno, never had the Tax Department under Gibbon’s leadership conduct Net Proceeds of Minerals (NPM) tax audits of mining operations within Nevada. During Gibbon’s term market prices of precious minerals were at historical and significant high levels. The market selling price of Gold was in the $1,300 to $1,500+ per ounce range during Gibbon’s term. Gibbons was also a geologist and lawyer.
During Gibbons term Nevada lead North America in Gold and Silver production. Also Nevada was ranked No. 3 in the world for Gold production. After Mr. DiCianno’s testimony to the Nevada legislature that no NPM audits were conducted while Gibbon’s was governor he resigned the following day.

In the release of the Nevads Department of Taxation’s annual report in January 2012 which represented the fiscal year of July 1, 2010 through June 30, 2011, it was presented that the audit penetration rate (percentage of Nevada taxpayers audited of the total population of registered Nevada businesses) was the lowest amount in 6 years. The Tax Department during this 6 year period in the years 2006 and 2007, made a significant investment in new tax administration and audit software along with employee training to provide increased efficiency and audit performance. Accenture Consulting Services formerly a unit of Arthur Anderson & Co. was selected to design and implement the tax administration software. Revenue Solutions Inc. of Boston, Massachusetts was selected as a subcontractor by Accenture to design and implement the tax auditing software system.
Approximately $40,000,000.00 was invested in new tax administration and audit software. The results of this investment after implementation of this system as shown in Tax Department’s annual reports (2008, 2009, 2010) have been abysmal.
During the first full year of leadership under the new Director William Chissel the Tax Department was frought with turmoil and discontent.

Mr. Chissel exited the director’s position and was replaced by a former Deputy Attorney General assigned to the Department, Christopher G. Nielsen. Mr. Nielsen assumed the Executive Director’s duties on July 1, 2012. Mr. Nielsen was previously a Deputy Director of the Tax Department and was also an Acting Director after the termination of Dino DiCianno. Mr. Nielsen was in the position of Acting Director for several months prior to the appointment of William Chissel as Executive Director.

On February 14, 2012 the Las Vegas Review Journal did a series of stories entitled “Taxation Department losing tens of millions of dollars a year, ex-employees say”. The story tells the various scandals that occurred in the Nevada Department of Taxation under Director Dino DiCianno. [30] [31]

After one year into his term as Governor, Nevada received a D- and ranked 42nd among states for anti-corruption and government transparency efforts, according to a new report from State Integrity Investigation. [32]

In response to the wholesale corruption validated by the D- grade, a large number of Nevada citizens formed a coalition called the Nevada ANTI-Corruption movement.

The ANTI-Corruption movement held a series of demonstrations at the State Capital in Carson City, NV starting in April 2012. [34] [35]

The Nevada ANTI-Corruption movement created a website www.NevadaStatePersonnelWATCH.wordpress.com and a youtube video series called CSI: Carson City to correspond to the massive 130 foot long by 4 foot tall Crime Scene banner.

The ANTI-Corruption movement received massive media coverage and the CSI: Carson City videos went “viral” on youtube.

Sandoval is rumored to be on the short list for Republican President hopeful Mitt Romney’s Vice President pick. [36]

We will also do mini demonstrations and adapt to the areas and various protest zones. We may use billboards and mobile signs and other new techniques to get our message out and promote our websites.

We took the protest to Reno on July 26, 2012

We took the protest to Reno on July 26, 2012 for new photo shoots and scouted out new areas to protest. We setup early at the Nevada Department of Taxation and got the employees coming into work and the morning rush hour traffic on Kietzke lane. The protest area was small and we’ll consider more protests in this area and adapt to the limited area.  Of course, we can setup across the street for the next protest at this location.

We then took the protest the the Reno offices of the Nevada Attorney General on Kietzke Lane at the round-a-bout near Hwy. 395.  This was a very busy area with tens of thousands of cars zooming by.  The signs worked well and we commanded attention from traffic in both directions and traffic heading to Hwy. 395 south.

We shot a ton of footage and we’ll be using these images for the new videos.  New videos are being produced to detail the corruption in the Nevada Department of Taxation.  This will cover the IT system issues, the personnel issues and the constructed lax audits on mining and other industries.

We are also producing short videos that may be released very soon.  The themes are “Halftime in Nevada” based on the Chrysler 2012 Superbowl ad ‘halftime in America’ starring Clint Eastwood.  We will try and adapt the story from Detroit, Michigan to Carson City, NV. The theme is good and appropriate as ANTI-Corruption founders Mike Weston and Ty Robben await legal answers from the courts on their cases described on http;//NevadaStatePersonnelWatch.wordpress.com
