Court Rules That Police Can (Without a Warrant) Install Hidden Spy Cameras on Your Property

A Wisconsin judge ruled this week that under certain circumstances police have the right to set up hidden surveillance cameras on private property without having a search warrant.

U.S. District Judge William Griesbach said that police on the hunt for two men suspected of growing 30 to 40 marijuana plants in an open field in Green Bay, Wis., were in the clear to set up several “covert digital surveillance cameras” in that field without judicial approval or the property owner’s permission, CNET reported.

The judge argued that the secret cameras did not violate the Fourth Amendment – which protects people and their property from unreasonable search and seizure by authorities — because neither Manuel Mendoza nor Marco Magana owned or leased the land. Therefore, they could not expect privacy on the property. Plus, the judge said, the Fourth Amendment only extends to a “home and land directly outside of it,” according to tech blog Ars Technica.

The property where the cameras were installed is a wooded area distant from homes, with a locked gate and a “no trespassing” sign, which indicated an expectation of privacy, the suspects argued. Griesbach disagreed, saying in his ruling: “Police officers would have to guess before every search whether landowners had erected fences sufficiently high, posted a sufficient number of warning signs, or located contraband in an area sufficiently secluded to establish a right of privacy.”

And since it’s legal for police to enter private property to collect evidence, it should be legal for them to set up cameras on private property for the same purpose, Griesbach said.

It was only after police recorded evidence in the field that they obtained a search warrant and arrested Mendoza and Magana on charges of federal drug crimes, according to Opposing Views. The suspects’ lawyers had asked the judge to throw out the videos as evidence.

Mendoza and Magana face possible life sentences in prison and up to $10 million in fines. They are expected to stand trial in January.

Though police have been cleared for their use of surveillance cameras in this case, others have landed in hot water over hidden devices. A landlord in East Hampton, N.Y., had a lawsuit brought against him in October by a family who discovered hidden cameras in the walls and air ducts of a home he’d rented to them. And a resident at a public housing complex in New York City was served an eviction notice after she installed security cameras on the crime-plagued property.

In some states, your driver’s license soon might not be good enough to board a flight, even if you’re traveling within the United States.

Before you start worrying, there are a boatload of caveats: The government’s decision will apply only to people in a handful of states. It wouldn’t take effect until at earliest the end of April. And DHS could still decide to postpone its decision, according to a DHS spokeswoman.
Why your driver’s license soon might not be good enough to board a flight
Ten years ago, the U.S. government passed the Real ID Act, issuing stricter standards for state-issued IDs, including drivers licenses. The idea was to toughen standards on what documents were needed to get a driver’s license, an effort to crack down on the potential for terrorists and criminals to obtain state-issued IDs. The act makes it harder to obtain a drivers license with counterfeit records.
Fewer than half (22) of the states have complied with the law.
Though the law states that noncompliant IDs cannot be used to board domestic flights, DHS and the TSA have not been enforcing that standard. But DHS has said it would make an announcement about enforcing the law on air travelers — and what that means for fliers — before the end of 2015. And here we are, in the last week of 2015.
Once the rules are enforced, affected travelers will likely need a passport or another valid government ID to fly.
The good news is that the majority of fliers in noncompliant states aren’t at risk anytime soon: 19 states have been granted waiver extensions through October 10, 2016, and four states are currently under review for an extension.
Five states are noncompliant
That leaves just five states that have been deemed noncompliant, have not been granted an extension and do not have extensions under review.

But even if you live in those states, don’t fret just yet: DHS hasn’t issued its schedule for enforcement. If and when it does, there still will be 120 days notice before the TSA no longer accepts their IDs.
And the situation is fluid: Those states could still appeal DHS’ decision not to grant a waiver extension, the DHS spokeswoman said.
Four states’ waiver extensions are pending review
These states applied for waiver extensions, and DHS is still reviewing their requests. All of these states were previously granted waivers that are set to expire on January 10, 2016.

19 states have been granted waiver extensions
Except for New Hampshire, all of these states’ waiver extensions are set to expire on October 10, 2016. New Hampshire’s extension lasts through June 1, 2016.

These states, along with Washington, D.C., already have issued drivers’ licenses that comply with the Real ID Act.

Lawsuits seek to abolish country’s bail bond system

SAN FRANCISCO (AP) — Crystal Patterson didn’t have the cash or assets to post $150,000 bail and get out of jail after her arrest for assault in October.

So Patterson, 39, promised to pay a bail bonds company $15,000 plus interest to put up the $150,000 bail for her, allowing to go home and care for her invalid grandmother.

The day after her release, the district attorney decided not to pursue charges. But Patterson still owes the bail bonds company. Criminal justice reformers and lawyers at a nonprofit Washington, D.C., legal clinic say that is unconstitutionally unfair.

The lawyers have filed a class action lawsuit on behalf of Patterson, Rianna Buffin and other jail inmates who argue that San Francisco and California’s bail system unconstitutionally treats poor and wealthy suspects differently.

Editorial: Eureka commissioners call on governor to support land use lawsuit


The day after Interior Secretary Sally Jewell declared that the greater sage grouse are “not warranted” for listing under the Endangered Species Act, but instead would be protected under a new Greater Sage-Grouse Land Use Plan Amendment (LUPA), Eureka and Elko counties and two mining companies filed a federal lawsuit seeking to block its enforcement.

The plan withdraws 10 million acres across the West — 3 million in Nevada alone — from future mining claims, prohibits oil and gas drilling near breeding grounds and imposes new reviews on grazing permits.

When state Attorney General Adam Laxalt joined the suit on behalf of the state, along with seven more counties, another mining company and a Humboldt ranch, Gov. Brian Sandoval fired off a sharp criticism of the litigation.

Assemblyman Richard Carrillo’s appeal of his misdemeanor DUI conviction will be heard by District Judge James Wilson Jan. 26, 2016, in Carson City.

Carrillo was arrested Feb. 27 after deputies found him sleeping in the driver’s seat of his sports car with the engine running.

Attorney Larry Dunn appealed the conviction by Justice of the Peace John Tatro arguing there was no evidence presented to indicate Carrillo, D-Las Vegas, drove the car to the parking spot outside Jimmy G’s saloon. Dunn argued the court must prove “beyond reasonable doubt” Carrillo drove the vehicle there while intoxicated, not simply he was passed out in the driver’s seat.

“Judge Tatro did not even mention the fact that there was uncontroverted evidence that Appellant did not attempt to operate the vehicle,” the appeal argues.

But Carson City Deputy District Attorney Amy Steelman argued Carrillo was nonetheless in control of the vehicle and, therefore, in violation of the law.

She cited a 1989 Nevada Supreme Court case in which, “the court found that a driver who was found asleep could still be in actual physical control of a vehicle.” Even if the person wasn’t trying to drive away, she said, the driver could have done so at any time.

Carrillo was first found asleep in a planter box a half block from the bar where he had been drinking. The patrol officer who found him said he woke Carrillo up and was told the assemblyman had a ride coming. That same officer found him a few minutes later in his sports car parked outside Jimmie G’s, again asleep and this time with his hand on the gearshift.

The deputy who arrested him said they were at the scene for nearly an hour and no one showed up to give Carrillo a ride.

He was charged with DUI and, when searched, had a .22-caliber pistol in his pocket — also illegal when intoxicated.

He was convicted by Tatro after a half day trial in July and ordered to perform 42 hours community service, pay fines totaling $800 and not be in possession of any firearms for at least a year.

Police are refusing to reveal the motive behind yesterday’s shocking attack when a woman deliberately ploughed her car into dozens of people in Las Vegas.

The culprit responsible for the horrifying incident, which killed one person and injured another 35, has been named as Lakeisha N. Holloway.

Immediately following her rampage, Holloway drove to a nearby hotel and told a valet to call 911, explaining why she had carried out the attack, although her motive remains a mystery because police are “uncomfortable” about disclosing it, according to Fox News’ Will Carr.


Las Vegas Metropolitan Police Sheriff Joe Lombardo said he doubted the attack was “militant” in nature, but refuses to rule it out at this stage. He added that Holloway “didn’t appear to be distressed due to her actions” and was “stoic” when she was arrested.

Holloway reportedly had a falling out with her father before the attack and had been living homeless in her car with her 3-year-old child for the past week.

Some respondents on Twitter speculated that the attack may have been racially motivated.

According to another eyewitness account, the woman screamed “Allahu Akbar” during the attack, although this is from a dubious source and cannot be considered genuine at this time.

The over-the-top reaction to Trump by politicians of both parties, the media, and the biggest corporations of America has been so swift and insanely angry that it suggests they are all threatened and frightened like never before.

Donald Trump can self-fund. No matter how much they say to the contrary, the media, business, and political elite understand that Trump is no joke. He could actually win and upset their nice cozy apple cart. It’s no coincidence that everyone has gotten together to destroy The Donald. It’s because most of the other politicians are part of the “old boys club.” They talk big, but they won’t change a thing. They are all beholden to big-money donors. They are all owned by lobbyists, unions, lawyers, gigantic environmental organizations, and multinational corporations . . . like Big Pharma or Big Oil. Or they are owned lock, stock and barrel by foreigners, like George Soros owns Obama or foreign governments that own Hillary with their Clinton Foundation donations.

These run-of-the-mill establishment politicians are all puppets owned by big money. But there’s one man who isn’t beholden to anyone. There’s one man who doesn’t need foreigners, or foreign governments, or George Soros, or the United Auto Workers, or the teachers’ union, or the Service Employees International Union, or the Bar Association to fund his campaign. Billionaire tycoon and maverick Donald Trump doesn’t need anyone’s help. That means he doesn’t care what the media says. He doesn’t care what the corporate elites think. That makes him very dangerous to the entrenched interests. That makes Trump a huge threat to those people. Trump can ruin everything for the bribed politicians and their spoiled slave masters.

Don’t you ever wonder why the GOP has never tried to impeach Obama? Don’t you wonder why John Boehner and Mitch McConnell talk a big game, but never actually try to stop Obama? Don’t you wonder why Congress holds the purse strings, yet has never tried to defund Obamacare or Obama’s clearly illegal executive action on amnesty for illegal aliens? Bizarre, right? It defies logic, right? First, I’d guess many key Republicans are being bribed. Secondly, I believe many key Republicans are being blackmailed. Whether they are having affairs, or secretly gay, or stealing taxpayer money, the National Security Agency knows everything.

Ask former House Speaker Dennis Hastert about that. The government even knew he was withdrawing large sums of his own money from his own bank account. The NSA, the SEC, the IRS, and all the other three-letter government agencies are watching every Republican political leader. They surveil everything. Thirdly, many Republicans are petrified of being called “racists” . . . so they are scared to ever criticize Obama or call out his crimes, let alone demand his impeachment. Fourth , why rock the boat? After defeat or retirement, if you’re a “good boy,” you’ve got a $5 million-per-year lobbying job waiting. The big-money interests have the system gamed. Win or lose, they win.

But Trump doesn’t play by any of these rules. Trump breaks up this nice, cozy relationship between big government, big media, and big business. All the rules are out the window if Trump wins the Presidency. The other politicians will protect Obama and his aides — but not Trump. Remember: Trump is the guy who publicly questioned Obama’s birth certificate. He questioned Obama’s college records and how a mediocre student got into an Ivy League university. Now, he’s doing something no Republican has the chutzpah to do. He’s questioning our relationship with Mexico; he’s questioning why the border is wide open; he’s questioning why no wall has been built across the border; he’s questioning if allowing millions of illegal aliens into America is in our best interests; he’s questioning why so many illegal aliens commit violent crimes, yet are not deported; and he’s questioning why our trade deals with Mexico, Russia and China are so bad.

Trump has the audacity to ask out loud why American workers always get the short end of the stick. Good question! I’m certain Trump will question what happened to the almost billion dollars given in a rigged no-bid contract to college friends of Michelle Obama at foreign companies to build the defective Obamacare website. By the way, that tab is now up to $5 billion. Trump will ask if Obamacare’s architects can be charged with fraud for selling it by lying. Trump will investigate Obama’s widespread IRS conspiracy, not to mention Obama’s college records. Trump will prosecute Clinton and Obama for fraud committed to cover up Benghazi before the election. How about the fraud committed by employees of the Labor Department when they made up dramatic job numbers in the last jobs report before the 2012 election?

Obama, the multinational corporations, and the media need to stop Trump. They recognize this could get out of control. If left unchecked, telling the raw truth and asking questions everyone else is afraid to ask, Trump could wake a sleeping giant. Trump’s election would be a nightmare. Obama has committed many crimes. No one else but Trump would dare to prosecute. He will not hesitate. Once Trump gets in and gets a look at “the cooked books” and Obama’s records, the game is over. The gig is up. The goose is cooked. Holder could wind up in prison. Jarrett could wind up in prison. Obama bundler Corzine could wind up in prison for losing $1.5 billion of customer money. Clinton could wind up in jail for deleting 32,000 emails, or for accepting bribes from foreign governments while Secretary of State, or for “misplacing” $6 billion as the head of the State Department, or for lying about Benghazi. The entire upper level management of the IRS could wind up in prison.

Obamacare will be defunded and dismantled. And Obama himself could wind up ruined, his legacy in tatters. Trump will investigate. Trump will prosecute. Trump will go after everyone involved. That’s why the dogs of hell have been unleashed on Donald Trump. Yes, it’s become open season on Donald Trump. The left and the right are determined to attack his policies, harm his businesses, and, if possible, even keep him out of the coming debates. But they can’t silence him. And they sure can’t intimidate him. The more they try, the more the public will realize that he’s the one telling the truth.

Nevada counties cry foul over Sandoval-Jewell sage grouse deal

Happy belated Bill of Rights Day


Several years ago I penned this for the Review-Journal. OK, I missed Dec. 15 by a couple of days this year.

On this day in 1791 the Bill of Rights were ratified by three-fourths of the states. At the insistence of the Anti-Federalists led by Thomas Jefferson the first 10 amendments were added to the new Constitution.

They might more properly be called a Bill of Prohibitions, since they are not so much a delineation of rights as a list of things the federal government may not take away from individuals and the states and local governments.

This is our day to celebrate the First Amendment prohibition against establishing a state religion, despite odd rulings about nativity scenes and posting the Ten Commandments, and the right of free speech and press, despite McCain-Feingold limits on campaign spending and advertising. (Since somewhat overturned by Citizens United.)
